What is delta 9 THC?
Delta-9 THC is the most plentiful psychoactive compound found in marijuana and hemp. Other psychoactive compounds include Delta-8 and Cannabidiol (CBD), which you’ve likely heard of.
In general, when somebody refers to Delta-9, they’re referring to THC.
What is hemp-derived THC?
Hemp-derived THC is a new creation that popped up after the 2018 Farm Bill was passed.
Simply put, it’s THC derived from a hemp plant instead of a marijuana plant.
What’s the difference between marijuana and hemp?
Marijuana is a cannabis plant that contains more than 0.3% THC by dry weight.
Hemp is a cannabis plant that contains less than 0.3% THC by dry weight.
How is hemp-derived THC legal?
Well, you see it’s not explicitly legal. It has more of an implied legality at the time of writing. Let’s call it unregulated.
It’s unregulated because the 2018 Farm Bill, a federal law, allows for “all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers” that come from legal hemp production.
Which means it’s up to the states to create regulations around these products.
Where is hemp-derived THC currently unregulated?
Hemp-derived THC is currently unregulated in 22 states:
Alabama
Arkansas
Florida
Georgia
Indiana
Maine
Missouri
Nebraska
New Jersey
New Mexico
North Carolina
Oklahoma
Texas
West Virginia
Wisconsin
Wyoming
Hawaii
Illinois
Kansas
Massachusetts
Mississippi
Pennsylvania
South Carolina
Where is hemp-derived THC prohibited?
Hemp-derived THC is explicitly prohibited in:
Alaska
Colorado
Delaware
Idaho
Montana
New York
North Dakota
Oregon
Rhode Island
Vermont
Washington
If you’re located in one of these states, you should google “hemp-derived THC in [insert state]” to see what the law says.
For example, in Colorado where the production of cannabis is plentiful, they have allowed for the production of hemp-derived THC products for sale in other states, but not for sale in Colorado.
Where else is hemp-derived THC allowed?
Hemp-derived THC is also allowed in the following states, but only if it’s produced and sold through the state's existing legal marijuana channels:
Arizona
California
Connecticut
Maryland
Michigan
Nevada
Utah
Is hemp-derived THC legal in Texas?
Yes, hemp-derived THC is legal in Texas because it is legal at the federal level and currently unregulated by state regulators of Texas.
When did hemp-derived gummies become legal?
Hemp-derived THC gummies became legal in 2018 with the passage of the 2018 Farm Bill mentioned above.
At first, clever hemp-processors realized that under the laws guidance, you could legally derive Delta-8 THC from hemp plants. In 2022, hemp-processors made over $2B from Delta-8 products.
Then, these same hemp-producers realized they could derive Delta-9 from hemp plants.
And the rest is history. We’ll see how the Delta-9 infused cookie crumbles.
Do hemp-derived THC edibles work?
Yes, they work very well! In fact, I’ve made it my mission to try all of the hemp-derived THC edibles / products on the market.

Are hemp-derived THC gummies safe?
Overall, the biggest concern around hemp-derived THC gummies is that there are no regulations around their production in the majority of states.
Therefore, there’s no watchdog to make sure that harmful chemicals aren’t added and that the production facilities they come from are safe.
Some states, such as Colorado, have extensive regulations around hemp-derived THC production and these products are available for sale in states that lack regulation, such as Texas.
But overall, you should be very picky about who you choose to buy these products from. You want to make sure they’re reputable and you can verify their production quality.
That’s where I come in.
